A sales engineer employed by Dynemech Systems Pvt. Ltd. was sent on field work to test a filter at a factory site 70 km from Delhi. After completing the assignment on 8 September 2007, he died in a road accident on the return journey. The employer and Commissioner had rejected compensation under the Employees' Compensation Act, 1923, holding the accident did not arise from employment. The Supreme Court allowed the appeal, holding that because the very nature of the deceased's employment required him to travel to the distant site, the accident occurred while incidental to employment. The Court remanded the case to the Commissioner to decide remaining issues of compensation.
