A woman died in a motor accident caused by rash and negligent driving. Her married daughter and elderly mother (aged 70) claimed compensation as dependents under the Motor Vehicles Act, 1988. The Supreme Court held that a married daughter cannot claim loss-of-dependency compensation unless she proves she was financially dependent on the deceased post-marriage. However, the elderly mother, who had no independent income and lived solely with the deceased daughter, remained entitled to dependency compensation. The Court awarded Rs. 19,22,356 to the mother, calculating loss of future income, funeral expenses, loss of estate, and filial consortium, while upholding the reduced award to the daughter as a legal representative under Section 140."
