In Brief
Deepa E.V., belonging to the OBC category, applied for a post with age relaxation and competed under OBC category. No general category candidate met the minimum cut-off marks. She sought accommodation in the general category, which was denied. The Supreme Court dismissed her appeal, holding that an OBC candidate who availed relaxation cannot claim appointment under the general category. Rule 9 of the Export Inspection Agency (Recruitment) Rules, 1980 and Department orders dated 1.7.1998 expressly bar this practice. The Court distinguished Jitendra Kumar Singh as involving a different statutory scheme without such express bar.
