Deepak Jhaveri and others sought to initiate criminal proceedings against Nikhilesh Keshrichand Jhaveri for allegedly making false statements in a motion (M.A. No. 782 of 2017) before the Supreme Court. Jhaveri had claimed issues had not been framed in a property dispute suit, when in fact they had been. The Supreme Court dismissed the application. Although the statements were factually inaccurate, Jhaveri had admitted the error in his rejoinder, provided a reasonable explanation (pendency of an application to reframe issues), and tendered an unconditional apology. The Court found no deliberate intent to mislead and thus no prima facie case for criminal prosecution for perjury."
