In Brief

The Delhi Development Authority challenged a High Court order that declared land acquisition proceedings had lapsed under the 2013 RTCS Act. The Supreme Court held that a subsequent purchaser has no standing to challenge acquisition or claim its lapse. Further, where possession of land has been taken by the authority, acquisition proceedings do not lapse merely because compensation remains unpaid. The Court applied the Constitution Bench decision in Indore Development Authority v. Manoharlal, overruling earlier precedents that had suggested otherwise. The impugned High Court judgment was quashed and the appeal allowed.
