DELHI DEVELOPMENT AUTHORITY vs VANDANA GUPTA

Bench: 2 — J.B. Pardiwala, Manoj Misra

In Brief

The Delhi Development Authority challenged the acquittal of two company directors by a trial court in a case involving unauthorized use of premises contrary to sanctioned plans under the Delhi Development Act, 1957. The High Court refused to grant the Authority leave to appeal. The Supreme Court dismissed the Authority's appeal, holding that the trial court's finding that the two acquitted directors were not involved in day-to-day affairs or management of the company was supported by evidence and no error of law existed in the High Court's refusal of leave.
