A bank dismissed its Head Cashier following an alleged fraudulent withdrawal from a customer's account. The Labour Court found the enquiry was unfair and declared the dismissal illegal, ordering reinstatement with back wages. The High Court reversed this, but the Supreme Court found the dismissal discriminatory since three other employees allegedly involved in the fraud were not dismissed. Considering the appellant had reached superannuation age and received substantial compensation (over Rs. 23 lakhs) while out of service since 1993, the Court modified the relief by treating him as having retired on completion of 15 years' service, settling retiral benefits without additional pension arrears.
