Dilip Kumar vs State of Maharashtra

Bench: 2 — Kurian Joseph

In Brief

Dilip Kumar sought to challenge a High Court order granting anticipatory bail but also directing him to pay Rs. 10 lakh in costs that the Supreme Court had awarded in a separate case. The Supreme Court held that the High Court erred in collaterally deciding on cost liability from a different proceeding during an anticipatory bail hearing. The Court ruled that such cost issues cannot be decided incidentally in unrelated proceedings and vacated the recovery direction, allowing the appeal.
