In Brief
This case involved a complaint under the Negotiable Instruments Act alleging dishonor of cheques issued as security for a loan. During trial, the trial court ordered the respondent to produce Income Tax Returns for seven years (2005-06 to 2011-12). The respondent challenged this order, which was set aside by the High Court. The Supreme Court held that directing production of Income Tax Returns for such a broad seven-year period was not justified. However, since payments were made between December 2011 and May 2012, the Court permitted limited production of returns for only the two relevant assessment years (2012-13 and 2013-14) to the appellant, striking a proportionate balance.
