Dinesh Yadav vs State of Jharkhand

Bench: 2 — Mohan M. Shantanagoudar

In Brief

Dinesh Yadav, a man over 72 years old, was convicted of attempting to murder an informant with a gandasa (sickle) during a land dispute. The High Court upheld his conviction under Section 307 IPC with five years' imprisonment. The Supreme Court found the eye-witness evidence credible and the non-examination of the investigating officer harmless. However, noting the spur-of-the-moment nature of the incident and absence of murderous intent, the Court reduced the conviction to Section 326 (causing grievous hurt). The appellant was sentenced to one year simple imprisonment and a fine of Rs. 50,000, with Rs. 45,000 to be paid as compensation to the deceased informant's legal representatives."
