Director, Department of Archaeology and Museums, Jaipur & Anr vs Ashish Gautam & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Department of Archaeology and Museums appealed against a judgment imposing a blanket ban on certain activities in a public garden or heritage site. The Court held that a complete ban was not justified where specific guidelines already existed. Instead of prohibition, the Court directed the Department to implement targeted restrictions, allocate adequate staff and supervisory resources, and submit consultant reports for monitoring beautification and development. The appeal was allowed with the Court reserving supervisory jurisdiction.
