Dr. Abraham Patani owned land in Mumbai on which a building was constructed. The Municipal Corporation proposed to build a connecting road through his property to alleviate traffic congestion between Mahakali Caves and the Central MIDC. Although the road had been deleted from the development plan in 1992, the corporation initiated acquisition under the Mumbai Municipal Corporation Act without obtaining formal approval to amend the development plan. The Appellants challenged the acquisition, arguing the Municipal Corporation could only act through the formal development plan amendment process. The Supreme Court held that the MMC Act and MRTP Act operate independently without hierarchy, allowing the corporation to invoke its own powers for land acquisition. The Court found substantial compliance with procedural requirements and held that the clear public interest in reducing traffic congestion outweighed the private property rights of the landowners, particularly since the road design would not disturb their buildings. The appeal was dismissed.
