Teachers in private aided colleges in Madhya Pradesh challenged their forced retirement at age 62, claiming entitlement to continue until age 65, as enjoyed by government college teachers. The Supreme Court held that the University Coordination Committee, under state law, has independent power to amend service Statutes without Executive Council approval. The Committee's 2004 decision to equalize retirement age at 65 years for aided private college teachers was a valid Statute amendment, not merely a recommendation. The Court ruled that aided private college teachers are entitled to work until age 65, and the State Government must pay their salaries accordingly, as government representatives on the Committee are bound by its decisions.
