In this guardianship dispute, a mother challenged an interim order granting custody of their minor daughter to the father, alleging he suffered from paranoid schizophrenia and had abused the child. The High Court, reviewing counsellor reports and video evidence, found the allegations of sexual abuse were not prima facie supported. The child, aged over 12 and studying in Class VII, was found to be articulate and unequivocal in her desire to live with her father, with whom she received love, care, food, education, and school support. The Supreme Court upheld the interim custody order, respecting the child's intelligent preference and welfare."
