A brother of a deceased tenant sought to inherit her tenancy rights under U.P. rent control law after her death during eviction proceedings. The Supreme Court held that a brother is neither an 'heir' nor a 'family member' under the rent legislation, as the statutory definition expressly excludes siblings. Furthermore, to inherit tenancy rights, an heir must prove ordinary residence with the deceased tenant at the time of her death. As the tenant was a woman who inherited the tenancy from her husband, succession law provided that tenancy would devolve on the heirs of her husband, not her brother. The court dismissed the appeal and ordered the appellant to vacate within four weeks.",
