In Brief
AMD Industries Limited (formerly Ashoka Metal Décor Pvt. Ltd.) manufactured crown corks used for sealing glass bottles. It sought tax exemption on modernized 'Double Lip Dry Blend Crowns' produced using advanced technology, claiming diversification under the U.P. Trade Tax Act. The Court held that true 'diversification' requires manufacturing fundamentally different goods, not merely improved versions of existing products through modern technology. Since both old and new products served the same purpose (bottle sealing), they were not goods of different nature. Exemption provisions must be construed strictly and literally. The appeal was dismissed."
