Eastern Coalfields Limited dismissed an employee (respondent Rabindra Kumar Bharti), a clerk, following departmental proceedings on corruption charges after he was arrested by the CBI. The High Court Division Bench stayed the dismissal order pending the outcome of the parallel criminal case, holding it would become operative only on conviction. The Supreme Court held this was unjustified because the respondent had already participated in the disciplinary inquiry that was permitted to continue, thereby revealing his defence. The Court observed that the extraordinary power under Order 41 Rule 33 CPC (to modify orders in appeal) is rarely invoked and was misapplied here, as the dismissal order itself was not challenged in the appeal. The Court allowed the appeal, set aside the stay order, and clarified that disciplinary and criminal proceedings operate independently with different standards and objectives.
