In Brief
The case concerned the validity of the extension granted to Ms. Anju Banerjee as Chairman-Managing Director of Educational Consultants India Limited for five years. After the Public Enterprises Selection Board recommended extension, the Central Vigilance Commission (CVC) wrote on 2 December 2010 raising complaints about the CMD and the abolition of the Chief Vigilance Officer post, advising the Ministry to place these facts before the competent authority. The Ministry investigated the allegations through a senior officers' committee, which found them without merit, and the competent authority approved the extension. The Supreme Court held that the CVC's advisory letter constituted proper vigilance input; no explicit clearance was necessary. The transparent decision-making process, which considered all CVC concerns independently, made the extension lawful.
