The Election Commission of India challenged a High Court order that struck down a clause in an electoral roll revision notice for graduates' and teachers' constituencies. The Supreme Court held that the revision of such electoral rolls must follow the same procedure as preparing a fresh roll, as prescribed in Rule 31(4A) of the Registration of Electors Rules, 1960. The requirement that voters submit fresh applications every six years satisfies Section 22 of the Representation of The People Act, 1950 by ensuring eligible voters have an opportunity to remain on the roll. The Court upheld the notice clause and set aside the High Court's order.
