An ex-sepoy (washerman) Ram Khilawan challenged his discharge from military service on the ground of low medical category. The Supreme Court held that discharge based on medical unfitness cannot be executed without mandatory examination by an Invalidating Medical Board. Since the discharge order was passed without this procedure, it was legally unsustainable. The Court allowed the appeal, striking down the discharge order and requiring the employer to follow proper medical protocols.
