Fazar Ali & Ors vs State of Assam

Bench: 2 — Ashok Bhushan

In Brief

Eight accused persons were convicted for the murder of Abdul Rahman under Sections 302 and 149 IPC following an armed assault on 12 November 1993. The appeal challenged their conviction on grounds that not all accused were named in the FIR and that eyewitness testimony contained contradictions. The Supreme Court held that FIR mention of "7 others" sufficed to allow later chargesheeting; minor contradictions between police and court statements do not undermine core evidence, especially when multiple assailants with different weapons are involved; and memory dimming over time does not destroy evidence credibility. The accused, sharing common object of assault and unlawfully preventing medical treatment for three hours (causing death), were rightly convicted. Appeal dismissed."
