In Brief

A trade union representing bank employees challenged provisions of the Nationalized Banks Scheme requiring that worker-directors have at least five years' service and must not reach superannuation during their term. The union argued this created unlawful discrimination against worker-directors compared to officer-directors. The Supreme Court upheld the provision, holding that workers and officers are distinct statutory categories governed by different laws, and therefore cannot claim equal treatment under Article 14. The Court noted that a board comprising diverse categories necessarily requires varying qualifications and that these must be assessed before, not after, appointment."
