Fekan Yadav vs Satendra Yadav @ Boss Yadav @ Satendra Kumar and Ors

Bench: 2 — S. Abdul Nazeer

In Brief

A father reported that his young son was kidnapped while travelling to school on 3 January 2017. The accused had previously threatened to make the father childless and had attempted to lure the boy out of school three months before the incident. The High Court granted anticipatory bail to the two main accused without stating reasons. The Supreme Court held that in grave kidnapping cases, anticipatory bail should not be granted without proper reasoning and careful evaluation of the severity of charges, supporting witness testimony, and the missing victim. The Court allowed the appeal and set aside the High Court's bail order.
