A deceased loading helper's daughter applied for compassionate employment 14 years after his 1995 death in service. Her application was rejected because her name was not in the original dependents list and she lacked sole-breadwinner status (her mother was employed). The High Court ordered reconsideration, but the Supreme Court reversed this decision. The Court held that compassionate appointments are humanitarian exceptions designed to provide immediate relief from financial destitution, not entitlements. After 24 years, such an appointment would defeat the scheme's purpose. The Court quashed the High Court orders and dismissed the appeal.
