In Brief
The Supreme Court addressed whether a High Court properly allowed an application seeking to clarify and modify an earlier settlement order in a construction licence dispute between neighboring landowners in Goa. The Court held that Applications for Speaking to the Minutes may correct only clerical or typographical errors, not substantive modifications. Since the High Court allowed the respondent's modification application without adequately hearing the appellant, the Supreme Court set aside both impugned orders and remanded the application to the High Court for fresh consideration on merits after providing both parties full opportunity to be heard.
