G.R. Ananda Babu vs State of Tamil Nadu & Anr

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

On 11 November 2019, an incident occurred resulting in an FIR under IPC Sections 143, 436, 302, 307, 149, and 120B. The accused filed three successive anticipatory bail applications before the Madras High Court. The first two were rejected. On the third application, the same judge who rejected the second application granted anticipatory bail, citing passage of time, accused's age, and willingness to cooperate. The Supreme Court set aside the grant, holding that successive anticipatory bail applications should not be entertained absent genuine change in circumstances. The status report showed the accused was absconding and custodial interrogation was essential. Appeal allowed; the order set aside.
