G. SHASHIKALA (DIED) THROUGH LRS vs G. KALAWATI BAI(DIED) THROUGH LR

Bench: 2 — Abhay Manohar Sapre, Dinesh Maheshwari

In Brief

Two civil appeals concerned a property dispute involving a suit for declaration of title and delivery of possession of a house, and a suit for perpetual injunction. The High Court dismissed the defendants' appeals while separately deciding the plaintiffs' application for additional evidence under Order 41 Rule 27 CPC. The Supreme Court found the High Court committed jurisdictional error by failing to apply binding precedent governing admission of additional evidence in appeals. The Court allowed the appeals, set aside the High Court's orders, and remanded the case for fresh hearing on merits in accordance with the correct legal principles.
