GAIL India Ltd appealed against orders of the Petroleum and Natural Gas Regulatory Board and Appellate Authority finding it guilty of discriminatory practices in denying common carrier pipeline capacity on a "reasonable endeavor" basis to a customer. The Supreme Court set aside both orders, finding that the lower authorities had failed to address a crucial issue: the applicability of the Affiliate Code of Conduct Regulations, 2008. The Court remitted the matter to the Board for reconsideration, allowing both parties to file additional pleadings, and directed the Board to dispose of the complaint within six months without expressing any opinion on the merits.
