In Brief
The appellant claimed a share in the deceased's estate arguing the property was joint family property and disputing the validity of the testator's will. The trial court had found no valid will, but the appellate court reversed, holding the will valid under Section 63(c) of the Indian Succession Act, 1925. On further appeal, the Supreme Court dismissed the appellant's challenge, holding that Section 63(c) does not require the testator to sign the will in the presence of both attesting witnesses simultaneously. Personal acknowledgement of the testator's signature to the witnesses is sufficient, provided they attest in his presence. The court found no statutory mandate for the witnesses to sign together.
