Gangadhar was convicted of narcotics offences under the NDPS Act, 1985. The Supreme Court set aside his conviction and acquitted him, finding that the trial court and high court had grossly misappreciated evidence and that the prosecution failed to establish a prima facie case. The Court held that despite a general reluctance to disturb concurrent findings, it must intervene to protect individual liberty when evidence is wholly insufficient and courts below arrive at conclusions unsupported by evidence. The appellant was directed to be released immediately.
