A man appointed as a Projectionist at a medical college hospital in 1991 was challenged by a competing candidate for allegedly lacking the required cinema operator license at the time of application. The High Court had quashed the appointment, but the Supreme Court allowed the appeal. The Court held that under the applicable Rules, an operator may obtain the certificate within three months of appointment; since the appellant acquired it within this period, his appointment was valid and not vitiated by the delayed certification. The appellant had served continuously for 28 years.
