Supreme Court of India 2019-09-12 dismissed

Ganpati Babji Alamwar (D) by LRs. Ramlu and Others vs Digambarrao Venkatrao Bhadke and Others

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court dismissed an appeal challenging a suit for redemption of a mortgage on agricultural land. The court held that Exhibit 52 was a mortgage by conditional sale, not a simple sale with repurchase option. The appellants' severe financial distress—having to mortgage 2.5 acres of land just for daily necessities—evidenced the true nature of the transaction. The defendants' bonafide purchaser status could not be conclusively determined without further evidence and did not vitiate the mortgagors' right to redemption. The appeal was dismissed accordingly.">
