Geeta vs State of Karnataka

Bench: 2 — B.V. Nagarathna, K.V. Viswanathan

In Brief

A woman died by self-immolation following neighborhood disputes with the appellant. The Trial Court convicted the appellant of abetting suicide (Section 306 IPC) and a caste-based atrocity offense; the High Court acquitted her of the latter but upheld the Section 306 conviction while reducing the sentence. The Supreme Court held that heated neighborhood quarrels, even with abusive language and alleged threats, do not constitute abetment of suicide unless the accused's conduct left the victim with no other option. Words spoken in anger without intent to cause suicide do not satisfy Section 306. The Court acquitted the appellant, holding the evidence insufficient to prove she intended or induced the victim to commit suicide.
