The Supreme Court held that the High Court of Orissa lacked jurisdiction to appoint an arbitrator under Section 11(6) of the Arbitration and Conciliation Act because the respondent had first initiated arbitration proceedings under Section 9 before the Court at Vishakhapatnam, Andhra Pradesh. Section 42 of the Act mandates that the Court where the first application is filed retains exclusive jurisdiction over all subsequent proceedings arising from the same contract. The High Court of Orissa erred in ignoring this jurisdictional objection and appointing an arbitrator.
