A Trust sued its Sevadar (servant) for rendition of accounts and removal from management of a Temple. The High Court set aside decrees in the Trust's favour, holding the suit unmaintainable under Section 92 CPC. The Supreme Court allowed the appeal, holding that Section 92 CPC applies only to suits against a Trust, not to suits by a Trust. The Trust was competent to sue and the suit was maintainable. The Sevadar's successor (Ram Niwas) could not inherit greater rights than the original defendant, who was merely a servant of the Temple.
