A lecturer appointed against a scheduled-tribe reserved post in 1989, when no ST candidate was available, sought arrears and benefits from his original appointment date. The High Court granted his entitlement but restricted payment to the three years preceding his writ petition (from 2008). The Supreme Court held that continuous representations from 1997 onwards showed the employee did not delay unduly, and the authorities failed to decide promptly. Since delay was not attributable to the employee, the court rejected the three-year limit and granted all arrears and benefits from his initial appointment in 1989, to be paid within three months.
