The Supreme Court found that the High Court had committed a clear error by citing the operative portion of the award instead of the actual reference while examining whether the reference was properly framed and whether the Tribunal exceeded its scope. Though the Tribunal's merits were not examined, this error on the face of the record warranted remand to the High Court for reconsideration on merits without any prior opinion on the substantive issues.
