Gokarakonda Naga Saibaba (Dr.) vs State of Maharashtra

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Dr. Gokarakonda Naga Saibaba was detained pending trial under the Unlawful Activities (Prevention) Act, 1967. The Supreme Court, on 29.02.2016, directed the trial court to hold day-to-day proceedings to examine eight material witnesses. By 04.04.2016, all material witnesses had been examined and cross-examined. The State opposed bail, claiming only eight formal witnesses remained and requesting two days' detention. The Court held that once material witnesses are fully examined and cross-examined, bail should not be opposed, especially considering the petitioner's clean bail record and poor health. Bail was granted on the petitioner's compliance with trial court conditions."
