In Brief
The Supreme Court quashed the Delhi High Court's decision that declared land acquisition proceedings lapsed merely because compensation was not tendered. The Court held that under Section 24(2) of the 2013 Act, proceedings do not lapse if possession has already been taken, even if compensation remains unpaid. The Court also ruled that a subsequent purchaser has no standing to challenge acquisition proceedings. Once possession is taken and an award passed, land vests in the State with no provision for divesting under Section 24(2).
