A government officer on deputation repeatedly sought permanent absorption. The High Court upheld departmental office memoranda stating he would not retain seniority from his initial appointment date. The Supreme Court allowed his appeal, holding that permanent absorption orders must include transparent terms and full disclosure. Since the officer had meanwhile been promoted conditionally pending litigation, the Court ruled that creating an ex-cadre supernumerary post was fairer than demotion. The seniority list would be maintained while allowing the officer to retain his promoted post without prejudice to the original absorption order."
