In Brief

The Delhi Government challenged a High Court order declaring a land acquisition void for non-payment of compensation under the Right to Fair Compensation and Transparency in Land Acquisition Act, 2013. The Supreme Court held that deemed lapse under Section 24(2) requires two conditions to be met: neither possession nor compensation have been provided. Since possession was lawfully taken before the Act came into force, the acquisition remained valid despite non-payment of compensation. The Court quashed the High Court's judgment and allowed the appeal.
