Delhi Development Authority and the Delhi Government sought review of Supreme Court judgments that had declared land acquisition proceedings lapsed under the 2013 Act, relying on the Pune Municipal Corporation precedent. After that precedent was overruled by a larger Bench in Manoharlal, they claimed a right to review. The Court held that subsequent overruling of foundational law does not permit review of judgments that were correct when rendered. The Explanation to Order XLVII, CPC bars review based on changed law. The Court dismissed all review petitions as unmaintainable, while extending a one-year window for fresh acquisition proceedings in the public interest and issuing detailed procedural directions for completion of the acquisition process.
