The Government of Delhi challenged amendments to the Government of National Capital Territory of Delhi Act 2021 regarding executive powers. A two-judge bench could not unanimously resolve whether Delhi's legislature has power over 'services' (Entry 41 of the State List) under Article 239AA of the Constitution. The three-judge bench found that the earlier Constitution Bench had not specifically addressed how Article 239AA applies to 'services'. Accordingly, the court referred the limited question regarding Delhi's legislative competence over 'services' to a five-judge Constitution Bench for authoritative interpretation.
