Gurcharan Singh vs State of Punjab

Bench: 1 — Amitava Roy

In Brief

A widow and her two daughters died by suicide in 2000, and the appellant (a brother-in-law) was convicted under Section 306 IPC (abetment of suicide) in a family property dispute. The Supreme Court acquitted the appellant, holding that the prosecution failed to prove the essential ingredients of abetment. Although the suicide note implicated the family, there was no expert proof of authorship, and cross-examination evidence revealed that property had actually been offered to the deceased and no complaints of ill-treatment had been lodged with police. The Court emphasized that abetment requires a clear causal nexus, deliberate mens rea, and sustained inducement—not mere domestic discord or the victim's hypersensitivity. Absent proof of actual cruelty and specific threats, conviction could not stand.
