Gurmit Singh Bhatia sought to be impleaded as a defendant in a suit for specific performance of a contract to sell, claiming title and possession to the property. The original plaintiffs opposed his impleading. The High Court declined to compel impleading. The Supreme Court upheld this, holding that a plaintiff cannot be forced to implead a third party (not privy to the contract) as a defendant against their will, even if that party claims title. The appeals were dismissed with no order as to costs.
