Halappa vs Malik Sab

Bench: 3 — D.Y. Chandrachud

In Brief

A 28-year-old agriculturist suffered permanent paralysis when a tractor fell on him during a demonstration in 2005, leaving him 100% disabled and wheelchair-bound. The Motor Accident Claims Tribunal awarded Rs. 8,66,000 in compensation, but the High Court reversed it, finding he was riding on the mudguard, an uninsured risk. The Supreme Court restored the tribunal's award, finding the tribunal's factual findings based on witness testimony sound. The Court enhanced compensation by Rs. 2,70,000 (to Rs. 11,36,000 total) to account for the severe disability and increased future medical expenses to Rs. 1,20,000, ordering 7% interest from the claim date until payment within 12 weeks."
