The appellants were initially acquitted by a trial court but a higher court partly allowed the State's appeal and convicted them for offences of simple hurt, voluntarily causing hurt with a weapon, and criminal trespass under the Indian Penal Code. They sought revision before the High Court, but the High Court dismissed the revision ex parte without assigning any reasons. The Supreme Court held that the High Court failed in its judicial duty by not applying its mind to the factual and legal aspects of the case. The Court set aside the dismissal and remanded the matter to the High Court for fresh consideration on merits.
