Haryana State Cooperative Labour and Construction Federation Ltd vs Unique Cooperative Labour and Construction Cooperative Society Ltd. & Anr

Bench: 3 — Jagdish Singh Khehar

In Brief

Haryana Federation sought to challenge an arbitral award dated 20.2.2008 but filed objections under Section 34 of the Arbitration Act only after a delay of 5 years and 8 months, following unsuccessful attempts before the Registrar of Cooperative Societies, the Principal Secretary, the High Court, and a Letters Patent Bench. The Supreme Court held that the statutory period for filing Section 34 objections is strictly three months plus thirty days for condonation, with no extension available through Section 14 of the Limitation Act when time was spent in wrong forums. The Court dismissed the appeal and imposed exemplary costs of ₹5,00,000 for abuse of judicial process through frivolous and repeated filings.
