HCL Infosystem Ltd. & Anr vs Central Bureau of Investigation & Anr

Bench: 2 — Adarsh Kumar Goel

In Brief

The Supreme Court upheld the Special Judge's jurisdiction to try HCL Infosystem and others in a National Rural Health Mission (NRHM) scam case, even after a public servant died before charge was framed and despite some charges being under the Indian Penal Code rather than the Prevention of Corruption Act. The Court distinguished an earlier judgment (Jitender Kumar Singh) because the Special Judge here was appointed to handle all NRHM scam cases, not just PC Act cases. Trying related offences from the same scam in one court prevents conflicting verdicts and serves justice. The Court found no threat to fair trial or miscarriage of justice, making the Special Judge's jurisdiction valid and appeals dismissed.
