Hemlata Eknath Pise vs Shubham Bahu-uddeshiya Sanstha Waddhamna & Ors

Bench: 2 — Dipankar Datta, Satish Chandra Sharma

In Brief

Hemlata Eknath Pise was dismissed from service but a Tribunal set aside the dismissal and ordered her reinstatement. The institution challenged this before the High Court, which remanded the case to the Tribunal after considering only one issue, without addressing other claims about breach of natural justice and the merits of the Tribunal's findings. The Supreme Court held that when multiple issues arise in a writ petition, the High Court must adjudicate all material questions with reasoned findings, not selectively remand on a single point. The Court set aside the remand order and restored the petition for fresh, comprehensive consideration by the High Court.
